Terms of Service

Welcome to Moansly(the “Platform”, “Service”, “we”, “us”), operated by [LEGAL ENTITY NAME], with a registered address at [REGISTERED ADDRESS]. By accessing or using the Platform you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Service.

1. Eligibility & Age

You must be at least 18 years old (or the age of majority in your jurisdiction, whichever is higher) to access or use Moansly. Creator accounts that publish sexually explicit content must complete government-ID verification before any premium content is published.

2. Account Registration

You agree to provide accurate, current, and complete information. You are responsible for safeguarding your password and for all activity under your account. Notify us immediately at /contact of any suspected unauthorized use.

3. User Content

“User Content” means anything you submit to the Platform (photos, videos, livestreams, messages, captions, comments). You retain ownership of your User Content. By submitting User Content you grant Moansly a worldwide, non-exclusive, royalty-free license to host, store, reproduce, transmit, display, adapt, and distribute it solely for the purpose of operating and promoting the Service.

4. Creator Eligibility & Compliance

All performers visible in User Content must be 18+ at the time of recording. We retain records as required by 18 U.S.C. § 2257 — see our 2257 Compliance Statement.
Creators agree to verify their identity and the identity of every performer in their content via our ID-verification partner.
Creators retain 85% of subscription, tip, and PPV revenue. Moansly retains a 15% platform fee. Payouts are processed weekly via our payment partner.

5. Prohibited Conduct

The following will result in immediate suspension and possible referral to law enforcement:

Any content depicting minors in a sexual context.
Content involving non-consenting persons.
Content depicting violence, gore, bestiality, or scat.
Impersonation or deepfakes without explicit consent.
Spam, fraud, scams, or attempts to bypass payment.
Solicitation outside the Platform that bypasses fees.

6. Payments & Refunds

Subscriptions, tips, and PPV unlocks are processed by our payment partner (CCBill or equivalent adult-friendly processor) and are non-refundable except where required by law. Token purchases are final. Chargebacks may result in account termination.

7. Intellectual Property & DMCA

We respect copyright. If you believe content on Moansly infringes your rights, see our DMCA Policy and file a takedown with our designated agent.

8. Termination

We may suspend or terminate your account at any time for any violation of these Terms. Upon termination your User Content may be removed; subscriptions you are paying will be cancelled and not renewed. Pending creator payouts remain owed subject to any chargeback / fraud holds.

9. Disclaimers & Limitation of Liability

THE PLATFORM IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, MOANSLY'S AGGREGATE LIABILITY TO YOU FOR ANY CLAIM RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (i) THE AMOUNTS YOU PAID MOANSLY IN THE 12 MONTHS PRECEDING THE CLAIM, OR (ii) US$100.

10. Governing Law & Dispute Resolution
